Coming soon, a new publication on human rights and business

The Inter-American Institute of Human Rights is pleased to announce that it is about to publish Human rights and business: the perspective from Latin America, a compilation of articles by academics and other experts on this important subject matter.

Representing a wide range of disciplines, although for the most part from a legal point of view, the contents recognize the globalization of the economy, “an international exchange that transcends national and regional borders that has promoted integration towards a large scale free market model with distinct social, economic and ethical consequences,” according to the Introduction of Humberto Cantú Rivera, who compiled the materials with the purpose of developing a debate regarding a dynamic in which businesses have become “subjects with important rights and prerogatives, but without the mínimum obligations to respect human rights or the environment in the communities and places where they operate.”

This interesting work, the first of its kind in Spanish, offers “a panoramic vision” on these matters, as stated in its Prologue by Surya Deva, a member of the UN Working Group on issues of human rights and transnational corporations and other business enterprises. The book discusses issues associated with the presence of megaprojects in the region and their consequences on the environment and on the human rights of indigenous peoples; the implications for States in terms of international contractual and litigious matters in claims courts; and the progress in international bodies, especially the UN Human Rights Council, which in 2011 strongly supported the Guiding Principles on business and human rights of John Ruggie. These Principles are also promoted broadly by the Working Group created to that end and the inter-governmental working group that is debating the feasibility of a binding treaty that would oblige businesses to comply with the international standards of human rights.
