The human right to respect for sexual orientation and gender identity in the Caribbean and Latin America : Current situation and prospects

This report compiles the results of an investigation carried out during the years 2017
and 2019 in Latin America and the Caribbean, based on a joint effort between the
United Nations Latin American Institute for the Prevention of Crime and the Treatment
of Offenders (ILANUD), the Inter-American Institute of Human Rights (IIHR) and
the International Bar Association (IBA). The collection of information from the
countries of the English-speaking Caribbean was assumed and coordinated by Dr.
Leonardo Raznovich1, while the coordination for the countries of Latin America, as well as the writing of the analysis of the information collected that is presented in
Chapter 2 , was in charge of Dr. Eugenio Raúl Zaffaroni.
The purpose of the project consisted of collecting data to establish the modalities
assumed by violations of the right to equality and the principles of non-discrimination
against LGTBI3 people throughout the region, and to highlight some of the reasons
why they have this character. At the same time, the project proposed to account for
the legislative, administrative, political and social efforts that seek to avoid these
Human Rights violations and advance towards equality for LGTBI people, evaluating
their effectiveness, as well as the difficulties they face in this part of the world. In
the particular case of the English-speaking Caribbean, the investigation sought to
identify the legislative figures that criminalize relations between people of the same
sex and their eventual judicial or administrative enforcement.
